03/ 13.04.2011 Heard learned counsel for the petitioner as well as learned

Addl. P.P. for the State.

Allegedly, alleged recovery of several kilograms ganja have

not been made for the conscious possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner

is languishing in jail custody since 14.8.2010.

Taking into consideration the above stated facts and

circumstances as well as submissions of the parties, let petitioner,

Mukhtar Khan @ Basir, be released on bail on furnishing bail bonds

of Rs 10,000/- with two sureties of the like amount each to the

satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran

in Kangali P.S. Case no. 22/2010.

It is made clear that if any criminal antecedent of the

petitioner relating to offences of NDPS Act is found prior to the

institution of the present case, the learned court below shall be at

liberty to cancel the bail bonds of the petitioner.
