Background
1. The Applicant filed an RTI application dt.25.10.07 with the CPIO, SCR,
Vijayawada. He requested for the following information:
i) He was drawing a pay of Rs.5450 as on 1.1.96. At what stage his pay
was fixed on promotion as Head clerk w.e.f 19.2.96 under Rule
No.1313(1)(9)(1)
ii) Copy of the said fixation order.
The CPIO replied on 31.12.07 stating that OA No.72/06 filed by the Applicant
before the Hon’ble CAT Hyderabad has been discussed in the parawise
remarks in the counter statement filed. The Hon’ble CAT/HYB had also
discussed it and considered the case to be devoid of any merit and dismissed
the OA. He added that in response to the Applicant’s earlier representation a
detailed reply was given on 13.2.07. However, he enclosed copies of the
office letters dt.27.9.05, 16.2.07 and Order dt.20.2.06. Not satisfied with the
reply, the Applicant filed an appeal dt.5.3.08 with Appellate Authority. The
Appellate Authority replied on 24.3.08 enclosing the copy of the fixation
chart. Aggrieved with the reply, the Applicant filed a second appeal
dt.28.4.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 3, 2009.
3. Mr. P. Kishore Babu, Sr. DPO cum CPIO, Mr. B. Jayaraj, ADRM cum Appellate
Authority and Mr. V. Ramanathan, O.S. represented the Public Authority.
4. The Applicant was present during the hearing.
Decision
5. The Appellant requested for the letter by which he was promoted as
Head Clerk with a pay fixation of Rs.5000-8000 w.e.f. 20.2.1996. The
Respondent provided to him, before the Commission, the fixation chart from
the Appellant’s service register and stated that the fixation was calculated
based on the 5th Pay Commission’s Recommendations and stated that the
chart provides details of how calculations were made and that no letter as
being sought by the Appellant, exists. On perusal of the information provided
and based on clarifications given by the Respondent to the Appellant, it was
observed by the Commission that complete information as available with the
Public Authority, has been provided to the Appellant.
6. The appeal is disposed of.
