                              O R D E R

Application for regular bail. The petitioner faces

allegations under the Kerala Abkari Act. The petitioner was

allegedly found to be in possession of 2000 litres of wash and 5

litres of arrack on 19/1/2007. Investigation is complete. Final

report has already been filed. The petitioner surrendered before

the learned Magistrate on 27/10/2007. He continues in custody

from that date. The petitioner has five other cases under the

Kerala Abkari Act, submits the learned Public Prosecutor.

2. The learned counsel for the petitioner prays, the

learned Public Prosecutor does not oppose the said prayer – as

the final report has already been filed and I am satisfied that

regular bail can be granted to the petitioner subject to

appropriate conditions. The learned Public Prosecutor submits

that considering the magnitude of the crime and the antecedents

of the petitioner appropriate and strict conditions may be

imposed to ensure the presence of the petitioner before the

court for trial.

3. In the result, this petition is allowed. The petitioner

shall be enlarged on bail on the following terms and conditions:

i) He shall execute a bond for Rs.1,50,000/- (Rupees

one lakh fifty thousand only) with two solvent sureties each for

the like sum to the satisfaction of the learned Magistrate.

ii) The petitioner shall report before the S.H.O of the

Kannavam police station between 5 p.m and 6 p.m on the first

and third Sundays of all English calender months until the case

against the petitioner is finally disposed of.
