Heard learned counsel for the applicant and learned A.G.A. appearing
for the State.
It is contended by the learned counsel for the applicant that the
applicant was not named in the FIR. The Investigating Officer recorded
statement of witness Smt. Manno Devi in which she made allegation
against the applicant and co-accused Kunwar Singh @ Mithau was
arrested and made confessional statement showing his involvement
along with applicant and except this there is no evidence against the
applicant to connect with the murder of the deceased. The recovery
has been made on the pointing out of the co-accused.
Learned A.G.A. contended that the applicant was involved in
committing the murder of the deceased.
Applicant was not named in the FIR. His name appeared in the
confessional statement of the co-accused. Perused the statement of
witness Smt. Manno Devi. The deceased himself was drinker and had
illicit relationship with the wife of Ramesh. The applicant is in jail since
29.3.2010.
Considering the facts and circumstances of the case and submissions
made by the learned counsel for the applicant and without expressing
any opinion on the merits of the case, the applicant is entitled to be
released on bail.
Let the applicant Ramesh Pasi involved in Case Crime No. 102 of
2010 under Sections 302 IPC Police Station Karchana , District
Allahabad be released on bail on his furnishing a personal bond with
two sureties each in the like amount to the satisfaction of the court
concerned.
