1. Heard the learned counsel for the applicant and the learned AGA and
perused the record.
2. The learned counsel for the applicant submitted that initially a charge sheet
was filed under section 498A, 307, 323 I.P.C. and section 3/4 of the Dowry
Prohibition Act, in which the learned Sessions Judge, Pilibhit admitted all the
applicants to bail. After release of the applicats on bail, the police submitted a
supplementary charge sheet under section 326 I.P.C. The applicants are,
therefore, required to seek a fresh bail in regard to the offence under section
326 I.P.C. It was further submitted that the bail prayer of the applicant in
regard to the offence under section 326 IPC may be directed to be disposed of
on the same day.
3. Keeping in view the facts and circumstances of the case and submission of
the learned counsel for the applicants and the learned AGA it is provided that
if the applicants appear and apply for bail in regard to the offence under
section 326 IPC relating to case crime no. 185 of 2009 of P.S. Jahanabad,
District Pilibhit, their bail application shall be considered and disposedof on
thesame day by both the courts below in the light of the principles laid down
by the Apex Court in Lal Kamlendra Pratap Singh versus State of U.P.
(2009) 4 SCC 437.
4. With the aforesaid observations, the petition under section 482 Cr.P.C. is
disposed of finally.
