Learned counsel appearing on behalf of the

petitioner states that the present application seeking suspension

of the execution of sentence and order of conviction dated

30.06.2007 passed in Tr. No. 3393 of 2007 ( arising out of

Pachrukhi P.S. Case no. 102 of 2004/ Hussainganj P.S. case no.

41 of 2005 has become infructuous. He, therefore, seeks

permission of the Court to withdraw the application.

As prayed for, the application is dismissed as

withdrawn.
