Dated this the 1st day of January, 2009
JUDGMENT
The petitioner had participated in the Revenue District Level
Youth Festival, Mavelikara. In the Band Melam, they were granted
second place with A grade, aggrieved by the same they filed an appeal
and that was rejected vide Exhibit P2 order. It is challenging Exhibit P2,
this writ petition is filed.
On the material findings available, I am not inclined to accept the
allegation that the location of the stage was detrimental to the petitioner.
In my view the contention that as the stage was in the midst of higher
buildings, it affected the sound has no substance. Further the grievance
must be a common grievance and there cannot be anything special in so
far the petitioner is concerned. Though the petitioner alleges that one
Sajeev trained the first prize winner and judging committee included his
friends, that by itself cannot vitiate the assessment of performance. That
apart, Sajeev was not a judge nor is a respondent in this writ petition.
Writ petition fails and hence, it is dismissed.
