                                JUDGMENT

Basheer, J.

When this appeal came up in the defect list on November 15,

2010, we directed the Registry to issue notice to the appellant directly,

since Adv.K.R.Sreekanth, who had instituted the appeal on his behalf,

was reportedly no more. Registry thereafter issued notice to the

appellant. It is seen from the endorsement that the appellant has

accepted the notice.

Today, when the case is taken up, the appellant is absent.

Therefore, the appeal is dismissed for default.
