Heard learned counsel for the accused applicant and learned counsel for the
State.
Perused the F.I.R. and other relevant papers filed in support of the bail
application.
Submission of the learned counsel for the accused applicant is that co-accused
Gaya Prasad has already been granted bail by this Court vide Crl. Misc. No.
6173(B) of 2009 dated 15.2.2010
It is further submitted that the allegation so levelled against the accused
applicant is similar to that of co-accused Gaya Prasad who has already been
granted bail by this Hon’ble Court. Learned counsel claim parity, which is not
controverted by the State. The accused applicant is in jail since 4.6.2009 as
averred in para 9 and has no previous criminal history as averred in para 10 of
the bail application.
Considering the facts and circumstances of the case, let the accused applicant
Keshan be enlarged on bail in Case Crime No. 303/09, u/S 363/366 IPC and
3(I)(X) of S.C & S.T. Act, P.S. Tanthiyawan, District Hardoi on his
furnishing a personal bond and two local and reliable sureties in the like
amount to the satisfaction of the court concerned/Remand Magistrate.
