                                           JUDGMENT

H.L. DATTU, CJ.

Questioning the correctness or otherwise of the orders passed by the learned Single

Judge in W.P.(C). No.34182/07 dated 26.11.2007, the petitioner in the Writ Petition has

presented this Writ Appeal.

2. What was questioned by the petitioner in the writ petition is the show cause notice

(Ext.P2) issued by the third respondent, Joint Registrar.

3. If for any reason the petitioner is aggrieved by Ext.P2 show cause notice, he could

have filed his objections to the same, to the effect that it is devoid of any merit and contrary

to the provisions of the Act. Without filing such objections, petitioner has rushed to this

Court.

4. In our opinion, the Writ Petition filed by the petitioner is fully premature.

Keeping that aspect of the matter in view, the learned Single Judge has rightly rejected the

Writ Petition.

5. We do not find any error in the orders passed by the learned Single Judge.

However, the appellant/petitioner is granted fifteen days’ time from today to file his

objections, if any, to Ext.P2 Notice issued by the third respondent, Joint Registrar. If such

an objection is received within the time granted by this Court, the third respondent shall

consider the same and take a decision in accordance with law, after hearing the petitioner.

Ordered accordingly.
