Facts

The matter, in short, is that the Complainant’s husband Dr. Prem Sagar
Gupta had booked a flat in Kanungo Coop. Group Housing Society Ltd,
Patparganj, New Delhi, way back in 1995. While allotments were made to
other members of the Society in 1998, allotment to Shri Gupta was made
belatedly in the year 2000. It is in this context that Smt. Alka Sagar had filed
an RTI application dated 3.1.2007 before Dy. Director (GH), DDA requesting
for the following information :-

“I would like to know whether there was supplementary letter for
additional members to be included in the above draw? If so, how many
members were added to the list for allotment on 20.9.1998? If so copy of the
letter approving modified list of members for allotment be provided.”

2. As she did not receive the requisite information from the DDA
authorities, she has filed the present complaint before the Commission.

3. The matter was heard on 30.4.2009. Smt. Alka Sagar is represented by
her husband Dr. Prem Sagar Gupta. DDA is represented by the officer named
above. It is the submission of Shri Umesh Kumar Sharma that DDA has no
role whatsoever in the allotment of flats by the cooperative society and the
same is done by the Society under the overall guidance of Registrar,
Cooperative Societies, Delhi. Dr. Gupta would submit that he has received
copies of number of documents from the office of Registrar of Cooperative
Societies but some documents are not available in the file that was inspected
by him in the Registrar’s office. Dr. Gupta, however, concedes that
information sought by him is to be provided by the Registrar of Cooperative
Societies and not by DDA. He, therefore, does not wish to pursue this matter
and proposed to file a fresh complaint before this Commission soliciting
certain information from the Registrar, Cooperative Societies, Delhi.

DECISION

4. The submission of Dr. Gupta is accepted. The present complaint is
ordered to be closed. A fresh complaint submitted by Dr. Gupta is taken on
record and order to be registered. Notices may be issued to the Registrar,
Cooperative Societies, Delhi, and the complainant for hearing on 29.5.2009 at
1100 hrs.
