        This in continuation of this Commission's Interim Decision dated
17.8.2009. As scheduled, the matter was heard on 1.9.2009. Appellant not
present. The public authority is represented by Shri J.K. Srivastava, CPIO & Shri
A.K. Parashar, Dy. Registrar, NHRC. Shri Srivastava would submit that the
complaint received from the complainant was forwarded to the competent
authority vide their letter dated 4.4.2007 for appropriate action. Subsequently,
vide letter dated 8.7.2008, the complainant was informed that no action could be
taken by NHRC in terms of section 36 of the Protection of Human Rights Act,
1993. He would also submit that the concerned file has since been weeded out
and that no action is pending at their end.

                                     DECISION
2.       In view of the above, the complaint is ordered to be closed.
