learned Advocate Mr. Haarshadray A. Dave for petitioner and learned
AGP Mr. Amit Patel for respondent State Authority.
In
present petition, petitioner has challenged order passed by Deputy
Secretary, Forest and Environment Department, Gandhinagar dated 21st
May, 2010 wherein Deputy Secretary has set aside order dated 6th
October, 2008 passed by Deputy Collector which, impliedly, also set
aside earlier order of Mamlatdar dated 31st January,
2008. Therefore, now, matter has been remanded back again to
Mamlatdar, Mahudha to decide entire matter a fresh and considering
further details as mentioned in paragra[ph 7 of order, and to pass
detailed reasoned order by Mamlatdar, Mahudha. Therefore, in light
of aforesaid reasoning given by Deputy Secretary, Forest and
Environment Department, Gandhinagar, let Mamlatdar, Mahudha may
consider entire matter a fresh and also directions issued by Deputy
Secretary, Forest and Environment Department, Gandhinagar and pass
appropriate reasoned order in accordance with law. There is no any
error committed by Deputy Secretary, Forest and Environment
Department, Gandhinagar in passing order in question which would
require interference of this court. Accordingly, this petition is
disposed of. DS Today.
