04. 05.07.2011 Petitioner has challenged the appointment
of Respondent No. 5, as Principal, M.K.S. College,
Trimohan Chandauna, Darbhanga on two grounds:
(i) Appointment on single post can not be
made on applying the reservation policy of the
Government; and
(ii) The Respondent No. 5 was teaching
Geography as a subject, but the college, in which he
has been appointed as Principal, Geography was not
being taught as subject. It is mandatory that the
Principal must be eligible for teaching one of the
subjects, being taught in the College, as “Principal”
also comes within the definition of word “Teacher”.
The Respondent No. 5 has entered
appearance through his Counsel. He prays for four
weeks’ time for filing Counter Affidavit.
Counsel, appearing for the L. N. Mithila
University, Darbhanga will also be directed to file its
Counter Affidavit during this period.
