J U D G M E N T
Petitioners are B.Sc Nursing students in a college affiliated
to the respondent University. The 3rd year results were
announced on 27/11/2010 and the petitioners failed in one
subject each. On 29/11/2010 itself, they applied for revaluation
and the results are awaited. While so, the 4th year examination is
scheduled to take place on 8/12/2010. In this writ petition, they
seek a direction to the University to permit them to appear for the
examination.
2. As rightly pointed out, as per the Regulations of the
University, unless a student has passed all the subjects of the
third year, the student cannot appear for the 4th year
examination. Therefore, the prayer sought by the petitioners to
permit them to appear for the 4th year examination is against the
regulations and cannot be allowed.
3. Be that as it may, since the petitioners have applied for
revaluation, it is directed that the University shall expedite
revaluation and declare the results before the next examination
