JUDGMENT

By way of this petition the
petitioner has prayed to direct the respondents, their agents and
servants to appoint the petitioner on compassionate ground in place
of his late father.

The brief facts of the case
are as under :-

As per the say of the petitioner the father of the petitioner
Hussainbhai junega, who died on 28.8.1998, during the service period
in the office of the respondent no.3. The petitioner was minor at
the time of death of his father. Mother of the petitioner has
provided the information regarding the dependant list as per the
requirement of the respondents.

After attaining the majority the petitioner requested the
authorities to give appointment on compassionate ground and the same
came to be rejected by letter dated 12.8.2006 on the ground of G.R.
dated 19.7.2006.

The petitioner has again made several representations. But nothing
turn back to from the respondents. Hence this petition.

Heard learned advocates for
the respective parties and perused the documents on record.

From the record it revealed
that since the petitioner is not possessing the requisite
educational qualification of Secondary School Certificate he is not
entitled for obtaining service on compassionate ground. In that view
of the matter, the view taken by the authority is just and proper.
No case is made out to cause interference. Hence petition stands
dismissed. Rule is discharged with no order as to costs.
