2. We heard this case through video conferencing. The Appellant was
present in the Rampur studio of the NIC. The Respondent was present in the
Bareilly studio. We heard their submissions.
3. The Appellant had sought a number of information regarding the loan he
and his brother had taken from the bank as well as about the onetime
settlement scheme in vogue. The CPIO had provided him with a number of
information in respect of his own loan but had refused to provide any such

information about the loan account of his brother on the ground that it was
exempted under Section 8(1) (j) of the Right to Information (RTI) Act. The
Appellate Authority had endorsed the decision of the CPIO.
4. After carefully considering the facts of the case, we think the CPIO
should confirm to the Appellant within five working days of receiving this order if
any written notice had been issued to the borrower before serving the RRC or
any such notice had been given only orally through personal contact.
5. There is no other information which the CPIO is required to disclose. We
agree with his decision not to disclose any information about the account of the
Appellant’s brother since the bank holds such information in commercial
confidence. Section 8(1) (d) of the Right to Information (RTI) Act clearly
exempts such information from disclosure. Such information should be sought
by the account holder himself or he should authorise the Appellant to obtain
such information on his behalf. Only then the CPIO should consider disclosing
the information. In regard to the OTS, the RBI guidelines are freely available in
the RBI website and the Appellant can easily access it from there.
6. The appeal is disposed off accordingly.
7. Copies of this order be given free of cost to the parties.
