Heard learned counsel for the petitioner,
learned counsel for the State and learned counsel for
Bihar Police Building Construction Corporation.
Petitioner has preferred this writ petition in
purported public interest alleging that the Managing
Director of the Corporation has not taken steps to reduce
the number of employees of the Corporation from 359 to
half of that figure and at the same time has appointed
about 157 employees on contract basis covering posts
from Class-I to Class-IV. Petitioner has raised another
issue that the audit report dated 26-6-2009 mentions
some financial loss which was not justified.
From the details appearing in the writ petition,
it is not clear as to what is the present strength of regular
employees of the Corporation and whether the

engagement of certain persons on contract basis is to
help in the working of Corporation or is against its
interest. Audit objection also does not appear to be
unusual and such objections are generally replied by the
concerned authorities in due course.
The details regarding the qualification of the
petitioner to maintain such a Public Interest Litigation
against activities of a public Corporation are also
lacking.
In the facts of the case, we are not persuaded
to continue with this matter as Public Interest Litigation.
The writ petition is, therefore, dismissed.
