Facts
By his letter of 7.9.2007, the appellant had requested for information in
regard to PAN number issued to Smt. Minoti Diren Pal. Besides, he had also
raised some general quarries for obtaining the PAN number etc. The CPIO
had decided the matter vide his order dated 22.11.2007, wherein he has
ordered supply of copies of PAN application and ration card of Smt Minoti
Pal to the appellant. On appeal, the Appellate Authority had decided the
matter by order dated 28.12.2007, setting aside the order of CPIO.
2. The present appeal has been filed against the order of the Appellate
Authority.
3. The matter was fixed up for hearing on 23.12.2008 but the parties did
not appear before the Commission. It has, therefore, been decided to dispose
of this appeal on the basis of material on record.
4. I have carefully gone through the order passed by the Appellate
Authority wherein he has refused to disclose information regarding PAN No.
of Smt Minoti Pal on the authority of Central Information Commission, in
case of Arun Verma Vs DGIG (Systems), New Delhi (Appeal No.
05/IC(A)/CIC/2006 dated 3.3.2006). The Appellate Authority has, thus, set
aside the decision of the CPIO who had ordered supply of copy of PAN
application and Ration Card of Smt Minoti Dhiren Pal to the appellant.
5. As regards the other general information requested for by the appellant,
the Appellate Authority in para 12 in his order has mentioned that this
information is available on the Income Tax Department Website. The
Appellate Authority has also found no merit in the submission of the appellant
that the information was furnished late.
6. On a thought full consideration of the matter, I find no infirmity in the
order passed by the Appellate Authority in setting aside the order of CPIO in
regard to supply of copies of PAN application and Ration Card of third party
(Minoti Pal) as his decision is in conformity with the decision of CIC referred
to herein above, and, for good reasons which I need not go into. I also agree
with the order passed by the Appellate Authority in regard to other ancillary
issues.
DECISION
7. In short, the order of the Appellate Authority is up held and the appeal
is dismissed.
