Heard learned counsel for the applicant, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicant has contended that applicant is not named in
the FIR and even his name did not appear in statement of the complainant and
only allegation against the applicant is that he was standing at the door. The
applicant is in jail since19.2.2010.
Learned A.G.A. has contended that the applicant was also present on the spot
when the occurrence was committed by the other co-accused.
The applicant was simply seen standing outside the door. The applicant is not
named in the FIR.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support
of the charge, the applicant is entitled to be released on bail.
Let the applicant Veeray alias Viresh involved in case crime no. 40 of 2010,
under section 302, 201, 120B IPC, P.S. Jaithara, District Etah be released on
bail on his furnishing a personal bond with two sureties each in the like
amount to the satisfaction of the court concerned.
