It
is submitted by Mr.Mishra appearing for the petitioner that there is
an order passed by the Labour Court, Rajkot dated 20th
November 2010 directing the respondent – Nagarpalika to
reinstate the petitioner in service.
It
is his grievance that in spite of this order, the Nagarpalika is not
complying with the same and the petitioner has received a
communication dated 2nd December 2010, wherein the
Nagarpalika has tried to explain that because of some orders passed
by this Court in Special Civil Application Nos.871/1988 &
11629/2000 and also because of some undertaking, it is not possible
to reinstate the petitioner. The communication dated 2nd
December 2010 (Annexure-‘B’) is not very clear and does not throw any
light on the subject.
Let
NOTICE be issued to the respondent, returnable on 11th
March 2011.
