ORAL ORDER

Heard
Mr.N.D.Nanavaty, learned Senior Advocate with Mr.Pravin Gondaliya,
learned Advocate for the petitioner.

It
is submitted that the petitioner is a bona-fide purchaser of the
land in question and that civil disputes are pending between the
original land owner and the complainant. It is further submitted
that none of the allegations made in the complaint constitute the
offences alleged against the petitioner. It is submitted that
purely a civil dispute is sought to be given the colour of a
criminal offence which is nothing but an abuse of the process of
Court.

Considering
the submissions advanced by the learned Senior Advocate, issue
Notice returnable on 15th
July, 2008. By way of ad-interim relief, further proceedings of the
First Information Report registered vide Bhuj Taluka Police Station
I-C.R.No.333 of 2006, are hereby stayed.

Mr.K.P.Raval,
learned Additional Public Prosecutor waives service of Notice on
behalf of respondent No.1-State of Gujarat.
