ORAL
JUDGMENT

RULE.

Mr.Nikunt Raval, learned Assistant
Government Pleader waives the service of notice of rule on
behalf of the respondents.

With
the consent of the learned advocates appearing on behalf of the
respective parties and in the facts and circumstances of the case,
present application is taken up for final hearing today.

Present
application has been preferred by the applicants – original
petitioners
to restore the main Special Civil Application which
came to be dismissed for non-prosecution on non-removal of the
office objections.

Mr.Apurva
Dave, learned advocate appearing on behalf of the applicants has
submitted that the office objections shall be removed on or before
15/2/2010.

In
the facts and circumstances of the case, present application is
allowed and the main Special
Civil Application is restored to file. The applicants
are granted time upto 15/2/2010 to remove the office objections. If
by 15/2/2010 office objections are not removed, the main Special
Civil Application shall again be dismissed for
non-prosecution without referring the matter to the Court. On
removal of the office objections on or before 15/2/2010,the registry
is directed to notify main Special
Civil Application on 17/2/2010. Rule is made absolute
accordingly. `
