petitioners, Mr Rajeev Kumar Verma, Senior Advocate appears for

opposite party no.2 and Mr. Nawal Kishore Prasad, learned Counsel

appears for the State.

Learned counsel for the petitioners submits that in this

case First Information Report has been lodged by the police on

receipt of complaint sent by the learned Chief Judicial Magistrate

under section 156(3) of the Code of Criminal Procedure without

making any preliminary inquiry. Learned counsel submits that the

above proposition would be substantiated.
