Heard learned counsel for the applicants, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicants has contended that the applicants are not
named in the FIR and the accused persons who were named in the FIR have
been exonerated by the I.O. and name of the applicants appeared in the
statement of co-accused Arif. There is no recovery of any incriminating
article from possession of the applicnats. The applicants are in jail since
21.5.2010.
Learned A.G.A. has contended that the applicants had illicit relationship
and they were involved in committing murder of the deceased.
Applicants are not named in the FIR. The main allegation is against co-
accused Arif.
Considering the nature of accusation and the severity of punishment in case
of conviction and the nature of supporting evidence, reasonable apprehension
of tampering of the witnesses and prima facie satisfaction of the court in
support of the charge, the applicants are entitled to be released on bail.
Let the applicants Smt. Farmeeda and Shahid involved in case crime no. 42
of 2010, under section 147, 148, 149, 302 IPC, P.S. Kithore, District Meerut
be released on bail on their furnishing a personal bond with two sureties each
in the like amount to the satisfaction of the court concerned.
