Heard learned counsel for the petitioner and learned Standing Counsel.
The present petition has been filed challenging the transfer order dated
30.10.2007 and the order dated 1.11.2007, inter alia, on the ground that the
petitioner has been transferred at a distance of 40 kms.
Submission of learned counsel for the petitioner is that the petitioner has been
transferred at the instance of certain persons in the department, who
kidnapped her daughter and thereafter an F.I.R. was lodged against those
persons. The petitioner has been made the victim on account of lodging of the
F.I.R. and has been transferred to a far off place from the present place of
posting. The petitioner filed Writ Petition No.7390 (S/S) of 2007 in which a
direction was issued on 19.11.2007 that the competent authority may decide
the representation of the petitioner. The representation of the petitioner was
decided by the C.M.O. and after enquiry it was found that the petitioner had
misbehaved with the Doctor. It is also submitted that the petitioner is going to
retire in the year 2011.
It appears that the Doctor must have been transferred by now and therefore,
the competent authority may consider the case of the petitioner for posting her
in a nearby hospital.
The writ petition is accordingly disposed of.
