Heard learned counsel for the applicant and Sri Ram Gupta, who has put in
appearance on behalf of opposite party no. 3.
This Court had passed an interim order on 18.11.1994, on which date notices
were also issued to opposite party no. 3. However, no counter affidavit has
been filed till date.
Sri Gupta has contended that no amount has been deposited pursuant to the
order of this Court dated 18.11.1994.
Learned counsel for the petitioner states that order dated 18.11.1994 has been
complied with inasmuch as the amount as indicated in the said order has
already been deposited by the petitioner.
As prayed by learned counsel for the opposite party no. 3, two weeks’ time is
granted for filing counter affidavit.
Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List after expiry of aforesaid period.
