Heard Mr. A. K. Mishra, learned counsel for the revisionist, learned AGA for
the State and perused the record.
Issue notice to respondent nos. 2 and 3, who may file counter affidavit within
four weeks. Rejoinder affidavit, if any, may be filed within one week
thereafter.
List immediately after expiry of the aforesaid period.
By the next date of listing the operation of the impugned order dated
29.5.2010 passed by the Chief Family Judge, Bareilly, In Criminal Case No.
1543 of 2009, Rajeev Kumar Srivastava Vs. Shalini Srivastava and the order
dated 1.5.2009 passed by the Chief Family Judge, Bareilly, in Criminal Case
No. 858 of 2008, Shalini Srivastava Vs. Rajeev Kumar Srivastava, shall
remain stayed provided the revisionist pays all the due amount till August
2010 calculated at the rate of one half of the amount as awarded by the trial
court by 31.8.2010 and continues to pay the same by 7th day of each month
from September 2010.
The amount so deposited by the revisionist may be withdrawn by respondent
nos. 2 and 3.
