ORAL
JUDGMENT

1. RULE.

Shri Pranav Dave, learned AGP
waives service of notice of rule on behalf of the opponents.

2. In
the facts and circumstances of the case and with the consent of the
learned advocates appearing on behalf of the respective parties the
present application is taken up for hearing today.

3. The
present application has been preferred by the applicant-original
petitioner to restore the main Special Civil Application, which came
to be dismissed for non-prosecution on non removal of the office
objections.

4. Shri
Shastri, learned advocate appearing on behalf of the applicant has
submitted that the application can be disposed of if the office
objections are dispensed with as the main Special Civil Application
can be heard and disposed of today by issuing suitable direction to
the revisional authority permitting the applicant to submit an
appropriate application before the revisional authority for
expeditious hearing of the Revision Application.

5. Under
the circumstances, the present application is allowed. Special Civil
Application (Stamp) No. 2837/2009 is restored to file. Office
objections are dispensed with.

6. Registry
is directed to give regular number to the main Special Civil
Application, which is heard today.
