Heard Sri S.M.A. Kazmi, learned Senior Counsel, appearing for the appellants
on this third application for bail.
A preliminary objection has been raised by learned Additional Government
Advocate that successive bail applications cannot be entertained as is
provided under the provisions of Section 389 Cr.P.C.
As it comes out, while rejecting the prayer for bail, this Court vide order dated
01.03.2006 had directed for preparation of paper book and for listing the
appeal for final hearing.
It is a case of double murder and this Court has very well taken into
consideration each and every aspect of the matter and had come to the
conclusion that the appeal be heard on merits.
The paper book is not on record. Learned counsel for the appellants shall
deposit requisite amount as provided under the Rules of the Court for
preparation of paper book and the office shall thereafter prepare paper book
and shall supply the same to learned counsel for the appellants.
The appeal shall be listed for hearing in the first week of September 2010
