02/ 24.02.2011 Heard learned counsel for the petitioner and learned

counsel for the respondents.

2. This writ petition has been filed by the petitioner

for directing the respondents to pay Rs.21,581.00 for the work done

by him in Bihar Road Construction Department, Patna. Learned

counsel for the petitioner submits that the said due is admitted one.

3. Considering the facts and circumstances of the

case, this writ petition is disposed of with a liberty to the petitioner to

file an application before the Chief Engineer, South Bihar, Road

Construction Department, Patna ( respondent no. 4) with respect to his

grievance. However, if such an application is filed before the said

authority by the petitioner within fifteen days from today along with a

copy of this order, the said authority shall decide the matter in

accordance with law by a speaking order within two months thereafter

and all the admitted dues should be paid to the petitioner immediately

thereafter However, if any due is found to be not payable by the

authority concerned, the petitioner will be at liberty to challenge the

said order of the Chief Engineer (respondentno.4) before an

appropriate forum.
