It
is very unfortunate that despite the recovery certificate issued long
back the amount is not recovered by the Mamlatdar and Alien Officer
and/or Collector, Ahmedabad and only notices are issued under
Sections 152 and 154 of the Bombay Land Revenue Code. It is the
experience of this Court that in so many matters, the
workers/labourers have to come before this Court only for the purpose
of appropriate direction directing the Mamlatdar and Alien Officer
and/or Collector to recover the amount under the recovery certificate
and it is found that in most of the cases except issuing notice under
Sections 152 and 154 of the Bombay Land Revenue Code no further steps
are taken at all. Hence, as a last chance, stand over to 29/10/2010.
If the amount under the recovery certificate is not recovered by
respondent no. 1 and/or officer of respondent no. 1, respondent no. 1
to personally remain present before this Court at 11:a.m.
Registry
is directed to give a copy of this order to Shri Neeraj Soni, learned
AGP to communicate the order to the Collector, Ahmedabad.
