In this case delay in filing the appeal has been condoned on 31.7.2009. The
trial court record has already been received.

It is contended by the learned counsel for the appellant that according to the
prosecution version only seven gram smack has been recovered from the
possession of the appellant and maximum sentence of four years has been
awarded to the appellant. The appellant was on bail during the pendency of
the appeal. He has not misused the liberty of bail.
Let the appellant Monu alias Meena Rathaur convicted in S.T. No. 122 of
2007 under Sections 21(B)N.D.P.S. Act P.S. Harbansh Mohal District Kanpur
Nagar be released on bail on his furnishing a personal bond and two sureties
each in the like amount to the satisfaction of the Court concerned.
The realization of fine shall remain stayed during the pendency of the appeal.
