Heard the learned counsel for the petitioner and learned A.P.P. for the
Prosecution.
The petitioner is apprehending his arrest in connection with Katras P.S.
Case No.104 of 2011, corresponding to G.R. No.1494 of 2011 for the alleged
offences under Sections 420 and 406 of the Indian Penal Code.
It is alleged that J.C.B. Machine was used in the digging work which was
alloted in the NAREGA Scheme. Learned counsel for the petitioner submits that
the petitioner is Mukhia of the Panchyat and the work was not assigned to the
Petitioner.
In the facts and circumstances of the case, I am inclined to release the
petitioner on anticipatory bail. Accordingly, it is directed that in the event of
surrender/arrest, the petitioner Nand Gopal Singh shall be released on bail on
furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like
amount of each to the satisfaction of learned Chief Judicial Magistrate, Dhanbad,
in connection with Katras P.S. Case No.104 of 2011, corresponding to G.R.
No.1494 of 2011, subject to the condition as laid down under Section 438(2) of the
Code of Criminal Procedure.
