Despite time having been granted to the respondents twice
to file counter affidavit, no response has been given.

In the circumstances, this Court is constrained to direct that
respondents shall appear before this Court in person on 2nd
February, 2010 to explain as to why no counter affidavit has
been filed in this case. However, in case the respondents file
counter affidavit by 27th January, 2010 and deposit a cost of
Rs.5,000/-, they need not to appear in person.

List on 2nd February, 2010.

Copy of this order shall be made available to learned
Standing Counsel for information to the concerned
respondents and compliance.
