Background
1. The Applicant who is a Senior Citizen having retired on 31.01.2006 from
MTNL after service of forty years and had not been paid any pensionary
benefits. filed RTI application dated 20.03.2009 seeking information about the
status of his pensionary benefits and about his own deposits/payments. The
Appellant was informed that his Application could not be processed since for
want of requisite fee vide letter dated …..03.09 from the Public Authority.
2. The CPIO, MTNL, vide covering letter dated 20.04.2009 enclosed detailed
information as desired by the Applicant by letter dated 17.04.2009 and
referring to letter dated 13.04.09. Being aggrieved by the PIO’s response, the
Applicant filed a First Appeal before the Appellate Authority on 29.05.09. The
Appellate Authority responded vide letter dated 06.06.2009 enclosing
therewith the letter dated 05.06.2009 received from CAO (Tax & Coord) O/o
GM (F).
3. The Applicant filed a Second Appeal dated nil challenging the AA’s response
dated 06.06.2009. While reiterating his contentions as raised in the RTI
application, the Appellant alleged that the order passed by the FAA to be
cryptic and vague. He further stated that the order of the FAA does not
disclose any material indicating pendency of enquiry, whereas the Appellant
had been issued clearance by the Vigilance Officer in the year 2005.It was
averred that the order was passed by the FAA without application of mind.
The Appellant further submitted that he was in receipt of letter dated
11.06.2009 without the enclosure from the Respondent Public Authority.
4. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 24, 2009.
5. Shri Paramatma Rai, CPIO, Shri Harbhagwan, Shri S.K. Bhatia, Shri R P
Singh and Shri Vineet Sharma SDE(RTI) were present during the hearing.
6. The Appellant Shri Anil Ku. Goel and Shri V.P Sharma were present during the
hearing.
DECISION
7. The Respondents submitted that the status of the pensionary and another
benefits has been s intimated to the Appellant. With regard to the
departmental major penalty charge sheet against the Appellant approved by
ED MTNL Delhi as indicated in the letter 15.05.09 from the Assistant Vigilance
officer, the Respondent stated that the case has been forwarded to the
Department of Tele communication in April, 2009 for clarification of certain
guidelines to ensure that there is no recurrence of cases in the future. In
these circumstances, the Commission directs the CPIO to forward the RTI
request to the DOT , while requesting the CPIO , DoT to provide the
information about the present status directly to the Appellant by 15.09.09,
under intimation to the Commission. The Appellant may approach the
Commission in the event of non compliance of the Order by the CPIO.
8. The appeal is disposed of.
