                                                               ORDER

Mr. Ravindran Shine, the Appellant vide his  RTI application dated 8.9.2010 sought 

certain documents such as his application dated 13.2.1980, his Dentist Training Certificate 

(Original),   DD   Rs.25/­   State   Bank   of   India,   Memorandum   No.   FDA.Dent/80­18   dt. 

23.8.1980, additional information submitted for the memorandum dt. 4.9.1980, Affidavit 

regarding House Owner attested by Notary Public, letter for practising as a Dentist in 

Pondicherry   as   proof   addressed   to   the   Registrar,   Dentists   Registration   Tribunal, 

Pondicherry,  Copy  of  ration card etc.  Shri  S.  Thammu  Ganapathy,  PIO  vide his  reply 

dated 7.10.2010 informed the Appellant that the information sought for was for the period 

between 1980 – 1982 and the office have not been able to trace these records from as 

early as 2005.   The First Appellate Authority Shri Raajiv Yaduvanshi before whom the 

Appellant filed an appeal, vide his order dated 9.12.2010 reiterated that records are not 

traceable as have been informed to the Appellant as early as 2005 while examining the 

directions as passed on the Appeal dated 12.7.1982 in Writ Petition No.732 of 2005 dated 
11.3.2005 of the Appellant for registration.  The FAA has also stated in his order that the 

State Dental Council for Pondicherry has been constituted vide notification dated 4.8.2010 

and the Dentists Registration Tribunal has ceased to function from the date of constitution 

of the State Dental Council and that   all the files have since been handed over to the 

newly constituted Council.  Therefore, the FAA held, that among the details sought for by 

the   Appellant,   only   particulars   of   the   names   and   addresses   of   the   Registrar   and 

Secretary(Health) for the period between 1990 to 30.8.2010 may be furnished by the PIO 

to the Appellant and the remaining information could be obtained from the State Dental 

Council.

After hearing the parties, the Commission observes that the Appellant could apply 

to the State Dental Council for getting the records regarding registration.   However, the 

CPIO is also hereby directed to transfer the RTI application of the Appellant to the State 

Dental Council u/s 6(3) of the RTI Act within 10 days of receipt of this order.

The matter is disposed of on the part of the Commission.
