02/ 04.10.2010 Heard learned counsel for the petitioner and

learned counsel for the State of Bihar and its authorities.

2. This writ petition has been filed by the

petitioner challenging the order of cancellation of his Fair Price

Shop License under the Public Distribution System.

3. Learned counsel for the petitioner submits that

against the said order he has filed an appeal under provision of

Clause- 15 of Government of Bihar, Food, Supply and

Commerce Department System (control) Order- 2001, which is

pending before the District Magistrate, Muzaffarpur.

4. Since the appeal has already been filed, this

writ petition is disposed of with a direction to the District

Magistrate to decide the appeal in accordance with law

including the decisions of this court in that regard

expeditiously, preferably within a period of two months from

the date of filing of the appeal.
