The
present application is for condonation of delay of 27 days in
preferring the cross objections in First Appeal No. 358/2009, which
has been admitted.

The
main contesting respondent no. 1, who is appellant of the First
Appeal, has been served. Ms. Thakkar, Ld. AGP appears for respondent
no. 2. Presence of respondent no. 3 may not be required at this
stage.

Considering
the facts and circumstances and in view of the grounds stated in the
application for condonation of delay, sufficient cause is made out,
hence, delay deserves to be condoned and, therefore, condoned.

The
application is allowed to the aforesaid extent. Rule made absolute
accordingly.
