The Commission directs the PIO to provide an affidavit to the Commission with a copy to the
Appellant stating that the documents sought by the Appellant are not available while giving reasons
for their nonavailability.

ORDER
Background
1. The Applicant filed an RTI application dt.6.8.10 with the CPIO, NIMR seeking the following
information:
i) Copy of letter sent by MRC to DG, ICMR to continue MRC Field Station at Nadiad, Gujarat
after its duration came to an end in 1984 as per MRC protocol attached to its letter dt.15.6.1982.
ii) Copy of approval of DG, ICMR to the proposal at (i) above
iii) Copy of letter with proposal sent to DG, ICMR to launch IDVC Project at Nadiad, Gujarat
and at 12 other locations in the country, in the year 1985.
iv) Copy of approval given by the DG, ICMR to the proposal at (iii) above.
Dr.Arun Sharma, CPIO replied on 3.9.10 enclosing the information as received from the
Administration Division. The Applicant filed an appeal dt.15.9.10 with the Appellate Authority
complaining that documents other than what has been sought in the RTI Application havee been
provided and reiterated his request for the information. Dr.Anup Anvikar, CPIO replied on 7.10.10
enclosing the information as received from the concerned section. Being aggrieved with the reply,
the Applicant filed a second appeal dt.18.10.10 before CIC reiterating his request for the information.
Decision
2. During the hearing, Shri J.B.Sharma, representing the Appellant submitted that prior to hearing, he
was informed by the Respondents that they would provide an affidavit stating that documents sought
are not available and added that he would be satisfied if the affidavit is provided.
3. The Commission accordingly directs the PIO to provide an affidavit to the Commission with a copy to
the Appellant stating that the documents sought by the Appellant are not available while giving
reasons for their nonavailability. The affidavit should reach the Commission/Appellant by 10.3.11
and the Appellant to submit a compliance report to the commission by 17.3.11.
4. The appeal is disposed of with the above directions.
