It is pointed out that the petitioner had earlier filed a petition under section
482 Cr.P.C. (Crl.Misc.Case No.3081 of 2009), which is pending before this
Court. Mr. Arun Sinha, learned counsel for the petitioner, however,
submitted that he has no knowledge of that petition. It is also pointed out that
in both the petitions affidavits have been filed by the same deponent but in the
present petition, the petitioner has not disclosed the fact of filing or pendency
of the earlier petition.

List in the next week along with Crl.Misc. Case No.3081 of 2009.
