Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.
It is contended by the learned counsel for the applicant that
applicant is not named in the F.I.R. and F.I.R. was lodged against
the son of the applicant. Thereafter the statement of the injured
was recorded in which it comes that applicant has poured
kerosene oil and her son set the deceased on fire.
Learned A.G.A. contended that applicant was also involved in
burning the deceased.
There is no allegation against the applicant in the F.I.R. Applicant
is in jail since 1.8.2009.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant and
without expressing any opinion on the merits of the case, the
applicant is entitled to be released on bail.
Let the applicant Razia Bi involved in Case Crime No. 447 of
2009 , under Sections 302, 452, 354 IPC Police Station Kotwali
District Rampur be released on bail on her furnishing a personal
bond with two sureties each in the like amount to the satisfaction
of the court concerned.
