02 19.08.2010 The writ petitioners are employees of the Magadh

University. It appears that they were originally appointed as

Laboratory Technicians then promoted as Demonstrators. By

virtue of the directions issued by the Human Resources

Department, Government of Bihar, Patna it is being said that they

would be treated as teachers and no payment would be made to

them. Similar issues are there in several writ petitions including

C.W.J.C. No.4846 of 2010, which is pending admission, in which

interim orders have been issued.

Consistently following with the same, I direct that the

orders of the State Government in the Department of Human

Resources Development to the above effect, as contained in

Annexures-10 to 16 except Annexure-11, shall remain in

abeyance, till further orders of this Court. Petitioners would be

entitled to be paid accordingly to their earlier pay scale.

Learned counsel for the State and the University upon

instructions being taken would be at liberty to file application for

vacating stay if so advised.

Put up these cases “for admission” as a zero item on

13th September, 2010.
