Heard Mr.Ranjeet Singh, learned counsel for the petitioner as well as
Mr.D.K.Upadhyay, learned counsel for the opposite parties.

Being aggrieved with the selection process initiated for appointment on the
post of Radio Therapy Technician, pursuant to the advertisement dated 31st
of October, 2008, the petitioner has filed the present writ petition seeking
relaxation in age for the period of service rendered in the department as Dark
Room Assistant, whereas Mr.D.K.Upadhyay, learned counsel for the
Department submits that there is no such provision to provide any such
relaxation and the petitioner may compete with others, if he holds eligibility
criteria as is provided under the terms of advertisement. The petitioner is a
regular employee and working on the post of Dark Room Technician. The
post in question is a direct recruitment post.

In the light of the aforesaid facts I am of the definite view that the petitioner,
if he is eligible in all respect may participate in the selection proceedings
alongwith other candidates, but in any manner the relaxation in age for the
period rendered in the department as a regular employee, cannot be provided
to the petitioner for appointment on the post in question.

In the result the petitioner’s claim failed and the writ petition is dismissed.
