Heard
learned advocate Mr. T.R. Mishra appearing on behalf of petitioner.

The
petitioner Union has raised industrial dispute by issuing strike
notice under Sec.22 of Industrial Disputes Act, 1947 on 29th
September 2009. On the basis of issuing strike notice to employer
with certain demands, a conciliation proceeding is initiated by
Assistant Commissioner of Labour, Surat in Conciliation Case No.52 of
2009, wherein, Union has also filed justification on 14th
December 2009.

In
view of this, it is directed to Conciliation Officer, Surat to
expedite the hearing of conciliation proceedings after giving
reasonable opportunity of hearing to respective parties.

It
is open for petitioner that if he wants to raise industrial dispute
in respect to grievance, then, he may raise it under the machinery of
Industrial Disputes Act, 1947.

As
and when such dispute is raised before appropriate Government, let
appropriate Government may consider and take appropriate steps under
the provisions of Industrial Disputes Act, 1947.

In
view of above observations and directions, present petition is
disposed of without expressing any opinion on merits.
