is stated by learned advocate Mr.Ashok H. Trivedi that direct service
obtained by applicant to serve the respondent, which was not accepted
by respondent and to that effect, affidavit is filed by applicant,
which is taken on record.

In
view of above, issue fresh notice to respondent, returnable on
26.2.2010.

Meanwhile,
Civil Court, Mahuva shall not proceed with HMP No.17 of 2008 till
next date of hearing.
