Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant contended that the First Information Report
was lodged on an application under Section 156(3) Cr.P.C.. There was
allegation that victim was alured and taken away by co-accused Mahendra.
The applicant is relative of co-accused hence, he was falsely implicated in the
present case. Prayer for bail of co-accused Sukhan was allowed in Cri. Misc.
Bail Application No. 3848 of 2009 on 12.02.2009 by another Bench of this
Court. However, applicant is in jail since 13.02.2010.
In view of the aforesaid fact without expressing any opinion on merit, let the
applicant Munna Lal be released on bail, in Case Crime No. 1305 of 2008
under Section 363, 506 IPC and 3(1)(10) AC/ST Act, P.S. Swar, District
Rampur on his furnishing a personal bond and two sureties each in the like
amount to the satisfaction of the court concerned.
