This is a Testamentary application wherein citation
has been published in the newspaper as directed by
this Court vide order dated 4.8.2009.
It is stated that the notices have also been served
upon next of the kins of the deceased as mentioned
in paragraph 2 of the application.
Office has reported that the notices have not been
returned back undelivered. The service is therefore,
deemed to be sufficient.

Learned counsel today has filed affidavit of no
objection by the next of the kins of the deceased.
Under the circumstances, I think it proper that the
matter be listed in the first weeks of February, 2010
as non contentious for final orders.
