Background:
Shri K.N. Maniyan of Indore filed an RTI-application with the Public Information
Officer, Indian Institute of Management Indore, on 28 May 2007 seeking information
relating to the interview proceedings for the appointment of Accounts Officer and
Finance & Accounts Officer.
2. The PIO vide his letter dated 29 May 2007 replied to his RTI-application. Not
satisfied with the reply of the PIO, the Complainant filed an appeal with the first
Appellate Authority on 13 August 2007 who vide his letter dated 12 September 2007
replied to it. Thereafter, the Appellant approached the Commission with a Second
Appeal on 14 May 2008, which was registered in the Commission on 26/05/2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the matter
on 16/10/2008.
4. Shri K.R. Narendra Babu, CAO , represented the Respondents.
5. The Complainant, Shri K.N. Maniyan, was present in person.
Decision:
6. The Commission heard both the sides with the PIO stating that because of
departmental problems and constraints and also because he had recently taken
over, he was not prepared for the case and wanted some more time. It would have
been better if he had informed the Commission earlier which would have adjourned
the case to another date so that another travel of both the PIO and the Appellant to
Delhi would have been saved. However, now that he has come and asked for some
more time, the case is adjourned for 12 November 2008 at 3.15 p.m. Since the
Appellant will be coming again for no fault of his, the Commission directs the
Respondents to pay him the full to and fro Delhi-Indore fare according to his official
entitlement and Rs.1,000/- for his stay in Delhi. In case the Respondents are able to
provide him the information desired by him in the meantime and the Appellant is
satisfied with the information received, he may give a letter of satisfaction to the
Respondents which they may send to the Commission so that the next hearing can be
avoided.
7. The Commission ordered accordingly.
