Mr.

Ramnandan Singh, learned Advocate for the appellant, has drawn the
attention of the Court to the Rojkam on Page-100/A of the compilation
as well as to the rough sketch annexed thereto, to submit that
immediately after the plaintiff’s house there is a wall of the
appellant and that there is no way between the house of the appellant
and the house of the plaintiff.

Having
regard to the aforesaid, issue NOTICE, returnable on
17TH OCTOBER, 2011.
